Section 504 Rehabilitation Act

What is Section 504?

This legislation was one of the first U.S. federal civil rights laws offering protection for people with disabilities within programs that receive federal funding. Section 504 is a civil rights law that prohibits discrimination against individuals with disabilities. Section 504 ensures that the child with a disability has equal access to an education. The child may receive accommodations and modifications.

WHO QUALIFIES UNDER SECTION 504

Students who do not qualify under IDEA, may qualify for a 504 Plan. To be protected under Section 504, a student must qualify and be determined to: (1) have a physical or mental impairment that substantially limits one or more major life activities; or (2) have a record of such an impairment; or (3) be regarded as having such an impairment.

WHAT DOES A 504 PLAN PROVIDE?

A Free And Appropriate Education consists of services designed to meet the individual educational needs of the student as adequately as the needs of non-disabled students. A 504 plan is to "level the playing field" so that disabled students have the same opportunity as a non-disabled student.
